(hereinafter also the provider), with registered address at Narcís Monturiol 16, Palau-solità i Plegamans, 08184, Barcelona, Spain, Tax ID number B60445921, customer service telephone 938648234, and email: hello@macramecord.shop, as the owner of the website www.macramecord.shop, presents the contractual document that will govern the contracting of products through the aforementioned website.
And on the other hand, the User – Customer (hereinafter the User), registered on the website using a username and password, for which they have full responsibility for use and custody, and are responsible for the accuracy of the personal data provided to the provider.
BOTH PARTIES ACCEPT this document, which implies that the user:
- a. Has read, understood, and comprehended what is stated herein.
- b. Is an adult and has sufficient capacity to contract.
- c. Assumes all the obligations established herein.
- d. Has read and accepts these present general purchase conditions from the moment they purchase any offered product.

These conditions shall have an indefinite validity period and shall apply to all contracts made through the provider's website.
The provider reserves the right to unilaterally modify these General Conditions, without affecting goods or promotions that were acquired prior to the modification, with the aim of improving the offered products. In any case, these general conditions should be consulted before making any purchases.
It is advisable to keep a copy of the data contained in the purchased products.
The provider is not responsible for any loss of data, files, or any damage that may result from a failure to back up the data contained in the purchased products, such as memory cards.
The provider is not responsible for any consequences that may arise from the improper use of the products for sale on the website.
MACRAME CORD is a company specialized in distance selling of artificial plants and flowers. MACRAME CORD sells its products remotely via the Internet through its website and/or by phone. MACRAME CORD does not have any physical stores for the sale of its products.
2. OBJECT OF THE CONTRACT:
2.1 Scope of Application: This contract aims to regulate the contractual relationship of purchase and sale that arises between the provider and the user when the user accepts these purchase conditions during the online contracting process by checking the corresponding box. These GC shall apply from the day the order is placed.
The contractual relationship of sale entails the delivery, in exchange for a specified and publicly displayed price through the website, of a specific product.
2.2 Territory of Application: The online store www.macramecord.shop is available for the entire Iberian Peninsula and some European countries.
2.3 Capacity to Contract: To place an order, you must be of legal age and have the legal capacity to enter into contracts.
2.4 Customer Acceptance: The validation of an order through the website www.macramecord.shop is done via email and implies automatic acceptance of the GC. These conditions are available on the website www.macramecord.shop or, if desired and requested, we can provide them to you via email.
2.5 Modification of the General Contract Conditions: The provider reserves the right to make changes and/or modifications to these GC. We advise our customers to review them regularly. If such changes or modifications are made after placing an order, the conditions in effect on the date the order was placed will apply.
3. INFORMATION PROVIDED ON THE WEBSITE www.macramecord.shop:
3.1 Publication of Prices: The prices of the products are displayed on each product on our website www.macramecord.shop
3.2 Product Information: The information displayed in our advertisements, brochures, other written materials, on our website, or provided to you constitutes an invitation to make a purchase. The contents of www.macramecord.shop are constantly renewed and updated to provide our customers with the most complete and detailed information possible. All contractual information displayed on www.macramecord.shop is presented in the Spanish (Castilian) language, and communication with customers and users, as well as the formalization of the contract, will be carried out in this language. However, if the customer wishes, it can be done in Catalan or another language, provided it is indicated before initiating the contracting process.
3.3 Product Availability: There may be occasions when it is impossible to supply all the products because they are out of stock or unavailable at the time of purchase. In these cases, the product in question will be visible but not available for purchase.
3.4 Right of Cancellation: The provider reserves the right to cancel the shipment of a specific product that does not meet the quality requirements imposed on all products of www.macramecord.shop. In the event that such lack of quality is detected, the MACRAME CORD Customer Service will suggest a replacement product, and if the replacement is not satisfactory to the customer, the cost of the product will be refunded.
3.5 Orders 24 hours a day, every day of the year: Orders are accepted 24 hours a day, 365 days a year. However, orders placed after 6:00 PM will not be processed and will be processed on the following business day in Palau-solità i Plegamans. Orders received on Fridays will be processed to arrive on Mondays or the first business day, and orders received on Saturdays until 10:00 AM will be delivered on Mondays (or the first business day thereafter). After that time, they will be processed on Mondays and delivered on the next business day on the peninsula, as stipulated in the corresponding section for orders outside the peninsula.
3.6 Fraud: If the provider suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.
4. PURCHASE PROCEDURE:
In order to access the products offered by the provider, the user must register on the website by creating a user account. To do so, the user must freely and voluntarily provide the required personal data.
The user will choose a username and password, committing to use them diligently and not to make them available to third parties. The user must also promptly notify the provider in case of loss, theft, or unauthorized access by a third party so that immediate blocking can be carried out.

This website also allows guest checkout functionality. In this purchasing method, only essential data required to process the order will be requested. Once the checkout process is completed, you will be offered the option to register as a user or continue as an unregistered user.
5. SHIPPING:

5.2 Shipping Costs: Standard shipping costs will be applied as follows:
For orders with a total value between €0 and €40 in products, the shipping cost will be as follows:
- National (Peninsular Spain): €6
- Peninsular Portugal: €6
- Balearic Islands: €12
For orders with a total value between €40 and €60 in products, the shipping cost will be as follows:
- National (Peninsular Spain): €4.5
- Peninsular Portugal: €4.5
- Balearic Islands: €9
For orders with a total value between €60 and €90 in products, the shipping cost will be as follows:
- National (Peninsular Spain): €3
- Peninsular Portugal: €3
- Balearic Islands: €6
For orders equal to or exceeding €90, shipping will be free of charge for the entire Spanish mainland territory, Balearic Islands, and Peninsular Portugal.
When the user adds the product to the cart and confirms the shipping address, the system will automatically display the aforementioned shipping costs.
5.3 Shipping Address:
The delivery of orders will be made to the user's freely designated delivery address. Therefore, the service provider assumes no responsibility if the delivery of the product cannot be made due to false, inaccurate, or incomplete information provided by the user or if the delivery cannot be made due to reasons beyond the control of the designated shipping company, such as the recipient's absence.
The shipping destination is chosen during the purchase.
The delivery schedule for the order will be during regular working hours.

Shipments are only made to destinations in Peninsular Spain and the Balearic Islands.

5.4 Delivery Deadlines: The delivery time is usually between 24 and 72 hours, depending on the product, the destination location, and the chosen payment method. This term is understood to apply only when the availability of the service has been confirmed and the full payment of the order has been verified. In the case of products that are not available at the time of purchase, our Customer Service may provide you with availability information.
If you have ordered multiple products in the same order, please note that they may have different availability dates, and as a result, you may receive them on different dates. 5.5 Shipment Confirmation: At the time of delivery to our carrier, we will send you a shipment confirmation to the email address provided when placing the order. The shipment confirmation will include the corresponding tracking number for you to track the shipment through our carrier's website.
5.6 Damages in Delivery: Products are shipped in secure packaging. If, at the time of delivery, it is visibly and clearly evident, without the need to manipulate the shipping packaging or the product packaging itself, that a product has defects caused by transportation damage or if there is an error in the received merchandise, the customer must immediately contact our Customer Service at 938 64 82 34 or email hello@macramecord.shop to request the return of the affected product(s) and proceed with its replacement with another in optimal conditions or a refund of the price paid, as indicated in the aforementioned email.
Likewise, if damages to the product are detected after opening the package while the packaging is in perfect condition, the consumer must inform the seller of the non-compliance within two months from the moment they become aware of it by contacting our Customer Service at 938 64 82 34 or email hello@macramecord.shop.
6. PRICES AND VALIDITY PERIOD OF OFFERS:
All prices displayed on the website www.macramecord.shop include the applicable VAT at the time of purchase. All prices shown on the website are valid and will be expressed in Euros (€). These prices, unless expressly stated otherwise, do not include shipping costs, handling, packaging, shipping insurance, or any other additional services related to the purchased product or service.
VALUE AD DED TAX: In accordance with the provisions of Article 68 of Law 37/1992, of December 28, on Value Added Tax (IVA), the delivery of products will be considered as taking place in the territory where Spanish VAT applies if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any given time, depending on the specific article in question. For orders destined for the Canary Islands, Ceuta, and Melilla, deliveries will be exempt from VAT in accordance with the provisions of Article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and duties in accordance with the current regulations in each of these territories.
The user will receive the order invoice at the email address provided by the user once the purchase has been made.
The prices applicable to each product will be those published on the website and automatically applied during the contracting process in the final phase of it.
In the case of limited-time promotions, the promotional discount will be applied only if the order has been registered during the promotion period.

7. PAYMENT METHODS:

8. RIGHT OF WITHDRAWAL:
8.1 Right of Withdrawal: The user has the right to exercise the right of withdrawal, and for this purpose, they have a period of 14 calendar days from the receipt of the product, without any penalty for its exercise. The consumer must be refunded the total amount of the purchase, that is, the price of the product plus the shipping costs, within 14 days following the exercise of the right of withdrawal by the user/consumer. Regarding the return shipping costs, these will be borne by the user-consumer. The exercise of the right of withdrawal is not subject to any formalities. The consumer will only be responsible for any diminished value of the goods resulting from handling them other than what is necessary to establish their nature, characteristics, or functioning, without limiting their right to exercise the right of withdrawal. To exercise this right of withdrawal, you can fill out this form with your order number (to receive a refund of the product(s) within a maximum period of fourteen (14) calendar days following the receipt of the order) along with your contact information. You can send it to us via email at hello@macramecord.shop or by postal mail (by any legally accepted means), always within 14 calendar days of receiving the order. After this period, you can only request the return or exchange of the product(s) for technical reasons subject to the warranty of the said product(s).
You must return the product with all the elements with which it was delivered, without any damage or signs of wear of any kind, and without indicating improper use or use different from its own nature to the address we have provided.
It is advisable to return the product in its original packaging. If this is not possible, the product may experience a depreciation in its value. The customer will be responsible for packaging and protecting the product(s) they are returning, as well as the expenses incurred for the return shipment.
As long as the products are returned within the 14-calendar day period, without any damage or signs of wear, and in compliance with the requirements established in this section, we will refund the total amount of the purchase.
Exceptions to the right of withdrawal: The right of withdrawal shall not apply to contracts that relate to:
a) The supply of goods made to the consumer's specifications or clearly personalized.
b) The supply of goods that may deteriorate or expire rapidly.
c) The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.
d) The supply of goods that, after delivery and taking into account their nature, have been inseparably mixed with other goods.
8.2 Return due to MACRAME CORD's Order Error: In case the product does not correspond to the order due to an error attributable to the company, the user must notify the company by email as soon as possible. MACRAME CORD will bear the costs of collecting the incorrectly shipped product and delivering the corresponding product of the placed order.
8.3 Verification of Returns: The verification and examination of the products subject to return will be carried out by MACRAME CORD, who, once the products are in their facilities, will verify that they meet all the requirements established in section 9.1. If any of the elements are missing, we will notify you in writing via email, indicating the missing content.
9. REFUNDS:
When a return is made (when exercising the right of withdrawal), the amount paid for the product plus the shipping costs will be refunded. The return shipping costs will be borne by the consumer-user. The refund must be made within a maximum period of 14 calendar days, using the same payment method used for the purchase.
10. APPLICABLE WARRANTIES AND AFTER-SALES SERVICES:
10.1 Warranty: All products offered through the website are completely original unless otherwise indicated in their description.
Satisfaction guarantee: If, at the time of receiving the product and before exercising the right of withdrawal, the user is not satisfied with the purchase, they can choose one of the following options:
1. Exchange the product for a voucher of the same value as the returned product, to be redeemed for another product of the same value (if the price of the product is higher than the voucher, the user must pay the difference),
2. Exchange the item for another one. If the price of the product is higher than the one being exchanged, the user must pay the difference.
10.2 Warranty in the case of a defective product: In the event of a defective product, MACRAME CORD must proceed with repair, replacement, price reduction, or contract resolution (as applicable), which will be free of charge for the user. MACRAME CORD is responsible for the lack of conformity that becomes apparent within a period of two years from the delivery; the consumer-user must inform MACRAME CORD of the lack of conformity within a period of two months from the date they became aware of it.
11. NULLITY AND INEFFECTIVENESS OF CLAUSES:
If any clause included in these General Conditions is declared null or ineffective, in whole or in part, such nullity or ineffectiveness will only affect that provision or the part thereof that is null or ineffective, subsisting the General Conditions in all other respects, and considering such provision, or the affected part thereof, as not included.
12. ONLINE DISPUTE RESOLUTION:
In accordance with Article 14(1) of Regulation (EU) No. 524/2013, the European Commission provides a platform for online dispute resolution (ODR) that allows consumers and traders to resolve disputes related to online purchases without going to court. This is done through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between both parties. This body is neutral and will engage in dialogue with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the dispute. 13. APPLICABLE LAW AND JURISDICTION:
These conditions will be governed and interpreted in accordance with Spanish legislation, except for any provisions expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions to the Courts and Tribunals of the provider's domicile (if not considered a consumer for the purposes of the TRLGDCU) or the user's domicile (if considered a consumer for the purposes of the TRLGDCU).
